By accessing or using DiffWatch (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and anyone who accesses or uses the Service.

You must be at least 16 years old to use the Service. By creating an account, you represent that you meet this age requirement. Each individual is entitled to one free-tier account. Creating multiple free accounts to circumvent plan limits is prohibited.
The Service operates under plan-based limits. Your current plan determines what you can do:
Exceeding your plan’s limits may result in request throttling or temporary suspension of monitoring until the next billing cycle. API keys are your responsibility — do not share them publicly or embed them in client-side code. You are responsible for all usage that occurs under your API keys.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:
We reserve the right to investigate and take appropriate action against anyone who violates this section, including immediate suspension or permanent termination of accounts, and reporting to law enforcement where required by applicable law.

Paid plans are billed through Polar.sh, who acts as the Merchant of Record for all transactions. By subscribing to a paid plan, you agree to Polar.sh’s terms and conditions in addition to these Terms.
You retain full ownership of your monitor configurations, API keys, and webhook settings. We do not claim any ownership over the content of websites you monitor.
We store website snapshots temporarily as required to compute diffs. Snapshot retention periods are determined by your plan (7 days to 1 year). Upon account deletion or plan downgrade, snapshots beyond the applicable retention period are deleted automatically within 30 days.
You are solely responsible for ensuring that your use of the Service to monitor third-party websites complies with those websites’ terms of service, robots.txt directives, and applicable law.
The Service and its original content, features, and functionality are and will remain the exclusive property of DiffWatch and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws.
Our trademarks and trade dress may not be used in connection with any product or service without prior written consent. Nothing in these Terms grants you any right to use DiffWatch’s name, logo, or branding.
You grant us a limited, non-exclusive, royalty-free license to access and process the URLs and configurations you provide solely for the purpose of delivering the Service.
You agree to defend, indemnify, and hold harmless DiffWatch and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney’s fees, arising out of or in any way connected with:
We strive to maintain high availability but do not guarantee uninterrupted service. The Service is provided on an “as available” basis. Scheduled maintenance will be communicated in advance where possible. We are not liable for downtime or data loss resulting from circumstances beyond our reasonable control, including but not limited to infrastructure failures, third-party service outages, or force majeure events.
The Service is provided “as is” and “as available” without warranty of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent permitted by applicable law, DiffWatch and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising from your use of or inability to use the Service.
In no event shall our total liability to you for all claims arising out of or relating to the Service exceed the total fees you have paid to us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.
You may delete your account at any time from the dashboard settings. We may suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we reasonably believe violates these Terms or is harmful to other users, us, or third parties.
Upon account deletion, your data will be permanently removed within 30 days, except where retention is required by applicable law. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification obligations, and limitations of liability.
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or, where arbitration is not permitted, in the courts of competent jurisdiction.
Nothing in this section limits either party’s right to seek injunctive or other equitable relief for violations of intellectual property rights or confidentiality obligations.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice within the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service before the changes take effect.
