Terms of Service

1. Agreement to Terms

By accessing or using DiffWatch (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and anyone who accesses or uses the Service.

2. Service Description

DiffWatch is a website change monitoring API designed for AI agents and developers. The Service provides:

• URL monitoring for detecting content changes
• Intelligent content diffing and comparison
• Webhook notifications when monitored pages change
• A REST API for programmatic access
• An MCP (Model Context Protocol) server integration for AI agents

3. Accounts

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access or security breach
• Accept responsibility for all activity that occurs under your account

You must be at least 16 years old to use the Service. By creating an account, you represent that you meet this age requirement. Each individual is entitled to one free-tier account. Creating multiple free accounts to circumvent plan limits is prohibited.

4. API Usage & Plan Limits

The Service operates under plan-based limits. Your current plan determines what you can do:

• Free: 3 monitors, 90 checks per month, minimum 24-hour check interval, 7-day snapshot history
• Pro ($29/mo): 50 monitors, 150,000 checks per month, minimum 15-minute check interval, 30-day snapshot history
• Business ($99/mo): 500 monitors, 1,500,000 checks per month, minimum 5-minute check interval, 90-day snapshot history
• Scale ($299/mo): 2,000 monitors, 10,000,000 checks per month, minimum 1-minute check interval, 1-year snapshot history

Exceeding your plan’s limits may result in request throttling or temporary suspension of monitoring until the next billing cycle. API keys are your responsibility — do not share them publicly or embed them in client-side code. You are responsible for all usage that occurs under your API keys.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:

• Use the Service for any illegal or unauthorized purpose
• Monitor, access, or scrape pages or resources you do not have permission to access
• Monitor URLs containing, distributing, or facilitating child sexual abuse material (CSAM) or any content that sexually exploits minors
• Use the Service to monitor phishing sites, malware distribution pages, scam operations, or illegal marketplaces
• Attempt to circumvent, disable, or interfere with rate limits, security features, or anti-bot protections
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use the Service in any manner that could damage, disable, or impair the Service or its underlying infrastructure
• Configure webhook endpoints in a way that constitutes spam or unsolicited communications to third parties
• Resell, sublicense, or provide third-party access to the Service without prior written consent
• Impersonate any person or entity or falsely represent your affiliation with any person or entity

We reserve the right to investigate and take appropriate action against anyone who violates this section, including immediate suspension or permanent termination of accounts, and reporting to law enforcement where required by applicable law.

6. Payment Terms

Paid plans are billed through Polar.sh, who acts as the Merchant of Record for all transactions. By subscribing to a paid plan, you agree to Polar.sh’s terms and conditions in addition to these Terms.

• Subscriptions are billed monthly and renew automatically unless cancelled
• You may cancel your subscription at any time; access continues until the end of the current billing period
• Refunds are issued at our discretion within 14 days of the initial charge or renewal
• Any changes to pricing will be communicated at least 30 days in advance
• We reserve the right to suspend or terminate access for non-payment or disputed charges

7. Data & Content

You retain full ownership of your monitor configurations, API keys, and webhook settings. We do not claim any ownership over the content of websites you monitor.

We store website snapshots temporarily as required to compute diffs. Snapshot retention periods are determined by your plan (7 days to 1 year). Upon account deletion or plan downgrade, snapshots beyond the applicable retention period are deleted automatically within 30 days.

You are solely responsible for ensuring that your use of the Service to monitor third-party websites complies with those websites’ terms of service, robots.txt directives, and applicable law.

8. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of DiffWatch and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws.

Our trademarks and trade dress may not be used in connection with any product or service without prior written consent. Nothing in these Terms grants you any right to use DiffWatch’s name, logo, or branding.

You grant us a limited, non-exclusive, royalty-free license to access and process the URLs and configurations you provide solely for the purpose of delivering the Service.

9. Indemnification

You agree to defend, indemnify, and hold harmless DiffWatch and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney’s fees, arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party right, including intellectual property rights or privacy rights
• Any claim that your use of the Service caused damage to a third party

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service is provided on an “as available” basis. Scheduled maintenance will be communicated in advance where possible. We are not liable for downtime or data loss resulting from circumstances beyond our reasonable control, including but not limited to infrastructure failures, third-party service outages, or force majeure events.

11. Limitation of Liability

The Service is provided “as is” and “as available” without warranty of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by applicable law, DiffWatch and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising from your use of or inability to use the Service.

In no event shall our total liability to you for all claims arising out of or relating to the Service exceed the total fees you have paid to us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

12. Termination

You may delete your account at any time from the dashboard settings. We may suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we reasonably believe violates these Terms or is harmful to other users, us, or third parties.

Upon account deletion, your data will be permanently removed within 30 days, except where retention is required by applicable law. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification obligations, and limitations of liability.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or, where arbitration is not permitted, in the courts of competent jurisdiction.

Nothing in this section limits either party’s right to seek injunctive or other equitable relief for violations of intellectual property rights or confidentiality obligations.

14. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice within the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service before the changes take effect.
